The 1985 and 1999 EU Directives on liability for defective
products and their implementing Member States' rules.
Private companies wishing to sell their products in the EU
have to cope with two complementary sets of rules governing product liability:
those deriving from EU Directive 85/374/EEC on the liability for defective
products (as amended by Directive 1999/34/EC) and the general rules on product
liability included in the legislation of each EU Member State. We have
experience in drafting sales contracts governed by Belgian law, in which product
liability clauses need to be adequately included.
